Barrow County’s Judicial System is made up of the Piedmont Judicial Circuit’s Superior and Juvenile Courts, the Office of the District Attorney, Clerk of Courts, Magistrate and Probate Courts, as well as the Public Defender.  The Piedmont Judicial Circuit is comprised of Banks, Barrow, and Jackson Counties. The Courts System, which is responsible for the hearings associated with criminal and civil actions, operates as follows:

The Probate Court handles birth certificates, marriage license, wills, and traffic laws.The Probate Court processed 3,500 traffic citations in 2002 and 5,500 in 2005. This represents an increase of 57 percent in citations associated with the Traffic Court.  On the other side of the office Probate cases have increased by 71 percent from 1,500 to 2,600.  In 2005 the Probate Court had the Elections division split in to the County Board of Elections.  In 2002 the Probate Court processed 69.7 tickets per 1,000 citizens, and the number of tickets increased to 91.7 per 1,000 citizens in 2005.

The Judicial System represents 9 percent of the overall general fund budget, and  percent of the county staff is represented in the judicial system.

Marriage License

Marriage License, are issued Monday thru Friday From 8:00 To 4:00 The charge is $51.00 W/O Marriage counseling; with proof of counseling on The State Form will be $16.00 Cash. State Form can be picked up in the Probate Court Office.

Bride and Groom must come in together and will each need to bring a picture

ID and a birth certificate, and know their SS# .

If either party has been married before you will need to bring your final divorce decree from the last marriage or a death certificate.

You must be 18 yrs of age or older, If 17, both parents will need to come in and sign, and bring their picture ID as well.

The Probate Judge performs weddings only by appointment, on Thursday and Friday Mornings If you desire to have the Probate Judge perform your wedding please call the Probate Office (770)307-3045 Ext. 3045 to make your appointment

Firearms License

Firearms License, are issued Monday thru Friday form 8:00 to 4:15 The charge is $44.00 cash You will need to bring your Drivers License to show proof of age ( must be
21) and proof of residency.
The process takes about 45min.
